Governor DeSantis signed Senate Bill 182 into law on March 18, 2019, and the law is effective as of this date. This bill allows a qualified physician to determine that smoking is an appropriate route of administration for medical marijuana. Qualified ordering physicians should be aware of several requirements about supply limits, consent forms, and documentation.
WHAT ARE THE SUPPLY LIMITS OF SMOKEABLE Medical MarIJUANA?
There is an ordering limit for a 35-day supply of marijuana in a form for smoking.
Each 35-day supply may not exceed 2.5 ounces. A physician certification may be for up to six 35-day supply limits. The limit on the amount a patient or caregiver may have in their possession is a total of 4 ounces.
When can I order marijuana in a smokable form for medical use?
A qualified physician must obtain written informed consent for marijuana in a form for smoking from the qualified patient or a qualified patient’s parent or legal guardian if the patient is a minor, and submit the required documentation if the qualified physician determines that smoking is an appropriate route of administration. If the boards’ proposed forms are in the rulemaking process but not officially adopted by rule yet, qualified physicians may still use those drafts as resources to meet the requirements. Otherwise, qualifying physicians will need to amend their existing consent forms to meet the requirements of law and submit the required documentation as provided in statute. Once the law became effective, a qualified physician may issue or update a qualifying patient’s certification to include marijuana in a form for smoking.
WHEN WILL SMOKEABLE MEDICAL MARIJUANA BE AVAILABLE?
Medical marijuana in a form for smoking will not be available from approved Medical Marijuana Treatment Centers (MMTCs) until the MMTC submits a variance, and the Office of Medical Marijuana Use (OMMU) approves the variance.
